This is the response I received from them today:
Mr. Hancock,
The 5,000 gallons of beer requirement is following the first year of operation, so your second year 5,000 gallons is your goal. As of now the only other option is a producer’s license, series #1. There has been talk about lowering the limit as you are not the only person to inquire on this.

So basically can still apply for the license if not producing the 5000 gallons and they are apparently working on adjusting the 5000 gallon lower limit.

Have you checked with any of the distributors (Crescent Crown, Young's, etc.) on what they have for a requirement? They also might have leads on how to get started - not sure about it. I did read a nice article in BYO or Zymurgy that specifically talks about the ropes to go through to start a Nano Brewery (licensing, laws, etc.)

4-205.08. Domestic microbrewery license D. A licensed domestic microbrewery is subject to all of the following requirements: 5. The microbrewery may make sales and deliveries of beer that it has produced to both: (a) Retail licensees that are under common ownership with the microbrewery in any amount. (b) Other licensed retailers in an amount not to exceed ninety-three thousand gallons in any calendar year. (up to 3,000 bbl under 20,000 bbl production cap; unlimited to same-ownership outlets)
There is an effort going on to research this and see how it does and does not apply and push forward with it. The initial result of their search was the 5000 gallon deal, but they are now taking another angle to see how it can apply.
This effort may indeed be of great interest to us homebrewers as the concept has us in mind and how we can become part of the effort... Stay tuned.
Permalink Reply by Zak Naldrett on January 12, 2012 at 11:32pm Is O.H.S.O. on Indian School still looking for a Nano Brewery license? I remember hearing that when they first announced they were opening possibly offering customers to brew their own beer.

OHSO has scaled up their plan. They don't intend on falling below the 5000 gallon minimum.
